NEW SECTION. 321.436A Exhaust systems = noise 1 2 limitation. 1 3 1. A person shall not operate a motor vehicle with an 1 4 exhaust system that produces engine noise of ninety=five 1 5 decibels or more unless the person has reasonable grounds to 1 6 believe that the operation of the vehicle will not result 1 7 in the vehicle's exhaust system producing engine noise of 1 8 ninety=five decibels or more. 1 9 2. A person shall not modify the exhaust system of a motor 1 10 vehicle to produce engine noise of ninety=five decibels or 1 11 more. 1 12 3. The decibel output of the exhaust system of a motor 1 13 vehicle shall be measured at a distance of fifty feet in a 1 14 manner that complies with the standards and testing procedures 1 15 established by the society of automotive engineers under SAE 1 16 J1492. 1 17 4. This section does not apply to motorcycles. 1 18 5. A violation of this section is a simple misdemeanor 1 19 punishable by a scheduled fine under section 805.8A, subsection 1 20 3. 1 21 Sec. 2. Section 805.8A, subsection 3, Code 2015, is amended 1 22 by adding the following new paragraph: 1 23 NEW PARAGRAPH. 0ag. Section 321.436A$ 20. 1 24 EXPLANATION 1 25 The inclusion of this explanation does not constitute agreement with 1 26 the explanation's substance by the members of the general assembly. 1 27 This bill prohibits a person from operating a motor vehicle 1 28 with an exhaust system that produces engine noise of 95 1 29 decibels or more unless the person has reasonable grounds to 1 30 believe that the operation of the vehicle will not result 1 31 in the vehicle's exhaust system producing engine noise of 1 32 95 decibels or more. The bill also prohibits a person from 1 33 modifying the exhaust system of a motor vehicle to produce 1 34 engine noise of 95 decibels or more. The bill provides that 1 35 the decibel output of the exhaust system of a motor vehicle 2 1 shall be measured at a distance of 50 feet in a manner that 2 2 complies with the standards and testing procedures established 2 3 by the society of automotive engineers. 2 4 The bill does not apply to motorcycles. 2 5 The bill provides that the scheduled fine for violating 2 6 these provisions is $20.
