H.F. 100 Section 1. Section 272.2, subsection 14, paragraph b, 1 subparagraph (2), Code 2023, is amended by striking the 2 subparagraph. 3 Sec. 2. Section 272.12, Code 2023, is amended to read as 4 follows: 5 272.12 Para-educator certificates. 6 The board of educational examiners shall adopt rules 7 pursuant to chapter 17A relating to a voluntary certification 8 system for para-educators. The rules shall specify rights, 9 responsibilities, levels, and qualifications for the 10 certificate. Applicants shall be disqualified for any reason 11 specified in section 272.2, subsection 14 , or in administrative 12 rule. Notwithstanding section 272.2, subsection 14 , paragraph 13 “b” , subparagraph (2), the The board may issue a para-educator 14 certificate to a person who is at least eighteen years of age. 15 A person holding a para-educator certificate shall not perform 16 the duties of a licensed practitioner. A certificate issued 17 pursuant to this chapter shall not be considered a teacher 18 or administrator license for any purpose specified by law, 19 including the purposes specified under this chapter or chapter 20 279 . 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill relates to the minimum age of applicants for 25 licenses from the board of educational examiners (BOEE). 26 Current law requires the BOEE to adopt rules that require the 27 BOEE to disqualify an applicant for a license if the applicant 28 is less than 21 years of age, with certain limited exceptions. 29 The bill strikes this requirement and makes conforming changes. 30 -1- LSB 1719YH (2) 90 jda/jh 1/ 1
