A
RESOLUTION
Proposing
an amendment to the Constitution so as to impose a charge on certain motor
vehicle registrations in this state which shall be transferred to the state
treasury for the purpose of funding the Georgia Trauma Trust Fund; to authorize
the General Assembly to adjust the amount of such charge and to provide for the
collection of such charge; to provide that such funds shall not be subject to
lapse; to provide for related matters; to provide for the submission of this
amendment for ratification or rejection; and for other purposes.
BE
IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
III, Section IX of the Constitution is amended by adding a new subparagraph to
Paragraph VI to read as follows:
"(o)
As used in this subparagraph, the term 'passenger vehicle' means every motor
vehicle designed to carry ten or fewer passengers and that is used for the
transportation of persons and shall include pickup trucks, motorcycles, sport
utility vehicles, and passenger vans. There shall be imposed a trauma charge of
$10.00 per year on each passenger vehicle licensed and registered in this state.
Such trauma charge shall be collected in the same manner and at the same time as
other license fees required by law are collected and prior to the issuance of a
license plate or revalidation decal for such passenger vehicle. This provision
shall not apply to vehicles owned by the state or its departments, agencies, or
authorities or by any political subdivision of the state. Such charge shall be
remitted to the state treasury for the sole purpose of funding the Georgia
Trauma Trust Fund. Funds of the Georgia Trauma Trust Fund shall not lapse as
otherwise required by Article III, Section IX, Paragraph
IV(c)."
SECTION
2.
The
above proposed amendment to the Constitution shall be published and submitted as
provided in Article X, Section I, Paragraph II of the Constitution. The ballot
submitting the above proposed amendment shall have written or printed thereon
the following:

year on certain motor vehicle registrations in this state which shall be
transferred to the state treasury for the purpose of funding the Georgia Trauma
Trust Fund?"

All
persons desiring to vote in favor of ratifying the proposed amendment shall vote
"Yes." All persons desiring to vote against ratifying the proposed amendment
shall vote "No." If
such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
