A RESOLUTION


Creating the Senate Local Government Contracting Study Committee; and for other purposes.

WHEREAS, the counties and municipalities of this state enter into numerous contracts each year for the provision of goods and services; and

WHEREAS, in entering into these contracts, the counties and municipalities are desirous of getting the best prices for such goods and services to minimize the cost to the taxpayers; and

WHEREAS, in many cases, counties and municipalities could achieve significant savings in the contracting for such goods and services if the counties and municipalities could enter into long-term contracts with vendors; and

WHEREAS, there presently exist significant legal and practical obstacles to such long-term contracts by counties and municipalities; and

WHEREAS, it would be beneficial to study the current laws, practical and legal impediments, and advantages and disadvantages regarding local government contracting to determine if changes are needed in the law to permit and facilitate long-term contracting by counties and municipalities in this state.

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that there is created the Senate Local Government Contracting Study Committee to be composed of five members of the Senate to be appointed by the Lieutenant Governor. The Lieutenant Governor shall designate a chairperson from among the appointees. The committee shall meet at the call of the chairperson.

BE IT FURTHER RESOLVED that the committee shall undertake a study of the conditions, needs, issues, and problems mentioned above or related thereto and recommend any actions or legislation which the committee deems necessary or appropriate. The committee may conduct such meetings at such places and at such times as it may deem necessary or convenient to enable it to exercise fully and effectively its powers, perform its duties, and accomplish the objectives and purposes of this resolution. The committee is authorized to utilize the assistance and expertise of representatives of the Association County Commissioners of Georgia, the Georgia Municipal Association, and the Carl Vinson Institute of Government of the University of Georgia in performing the work of the committee. The members of the committee shall receive the allowances authorized for legislative members of interim legislative committees from the funds appropriated to the Senate but shall receive the same for not more than five days unless additional days are authorized. In the event the committee makes a report of its findings and recommendations, with suggestions for proposed legislation, if any, such report shall be made on or before December 31, 2010. The committee shall stand abolished on December 31, 2010.
