A BILL TO BE ENTITLED
AN ACT

To amend Article 1 of Chapter 1 of Title 31 of the Official Code of Georgia Annotated, relating to general provisions relative to health, so as to provide that the act of a mother breast-feeding her child shall not be considered lewd, lascivious, indecent, or unlawful conduct; to provide that no person or entity shall cause a breast-feeding mother to leave a place because of such activity; to provide a penalty; to repeal conflicting laws; and for other purposes.

SECTION 1.

Article 1 of Chapter 1 of Title 31 of the Official Code of Georgia Annotated, relating to general provisions relative to health, is amended by revising Code Section 31-1-9, relating to breast-feeding of baby, as follows:

"31-1-9.

(a) The breast-feeding of a baby is an important and basic act of nurture which should be encouraged in the interests of maternal and child health. A mother may breast-feed her baby in any location where the mother and baby are otherwise authorized to be.

(b) The act of a mother breast-feeding her child, and any exposure of a breast associated with such breast-feeding, shall not be considered lewd, lascivious, indecent, or unlawful conduct.

(c) No person or entity, including, without limitation, a governmental entity, shall:

(1) Restrict, harass, or penalize a mother who is breast-feeding her child;

(2) Require a mother to leave the premises where she is otherwise entitled to be while breast-feeding; or

(3) Require a breast-feeding mother to leave a location on the premises where she is otherwise entitled to be.

(d) Any person violating subsection (c) of this Code section shall be guilty of a misdemeanor and, upon conviction, shall be subject to a fine not to exceed $300.00."

SECTION 2.

All laws and parts of laws in conflict with this Act are repealed.
