BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 2 of Article 3 of Chapter 6 of Title 32 of the Official Code of
Georgia Annotated, relating to control of signs and signals on the state highway
system, to provide for the authority of the Department of Transportation to
lease certain state property for industrial or commercial activity; to provide
for related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
2 of Article 3 of Chapter 6 of Title 32 of the Official Code of Georgia
Annotated, relating to control of signs and signals on the state highway system,
is amended by adding a new Code section to read as follows:
"32-6-73.1.
The
department may lease the use of areas above or below state highways or
transportation facilities for industrial or commercial activity. Leases
authorized under this Code section shall be subject to any restrictions or
conditions the department deems necessary to ensure the adequate protection of
safe and efficient utilization, operation, and maintenance of the state highway
system. Such leases shall comply with all applicable local zoning regulations
and ordinances. The department shall comply with the requirements of Article 4
of Chapter 2 of this title before entering into a lease agreement authorized
under this Code
section."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
