BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 12-5-29 of the Official Code of Georgia Annotated, relating
to sewage and waste disposal, withdrawal, diversion, or impoundment of surface
waters, certificates required for vessels with marine toilets, and conditions
for transfer of surface water from one river basin to another, so as to change
certain provisions relating to permit requirements and prohibited acts; to
provide an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 12-5-29 of the Official Code of Georgia Annotated, relating to sewage
and waste disposal, withdrawal, diversion, or impoundment of surface waters,
certificates required for vessels with marine toilets, and conditions for
transfer of surface water from one river basin to another, is amended by
revising subsection (b) as follows:
"(b)
No person, without first securing from the division a permit,
shall:
(1)
Construct,
install, or modify
Operate
any system for disposal of sewage, industrial wastes, or other wastes, or any
modification,
extension,
or addition thereto, when the disposal of the sewage, industrial wastes, or
other wastes constitutes pollution as defined in this article;
(2)
Increase the volume or strength of any sewage, industrial wastes, or other
wastes in excess of permissive discharges specified under any existing permit;
or
(3)
Construct
or use
Use
any new outlet for the discharge of any sewage, industrial wastes, or other
wastes into the waters of the state when such discharge constitutes pollution as
defined in this article."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
