BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 31-21-7, relating to disposition of remains of deceased
persons, so as to provide that in the priority list of persons authorized to
control the disposition of the remains of a deceased person, in the case of
deceased military personnel, the person designated on the deceased person's
United States Department of Defense Record of Emergency Data, DD Form 93 shall
have the second priority, after only a health care agent designated in an
advance directive for health care; to provide for related matters; to provide an
effective date; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 31-21-7, relating to disposition of remains of deceased persons, is
amended in subsection (b) by inserting between paragraphs (1) and (2) a new
paragraph as follows:
"(1.1)
If the deceased person died while serving in any branch of the United States
Armed Forces as defined in 10 U.S.C. Section 148, the person, if any, designated
by the deceased person as authorized to direct disposition as listed on the
deceased person's United States Department of Defense Record of Emergency Data,
DD Form 93, or any similar successor form adopted by the Department of
Defense;"
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
