BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 35-8-7 of the Official Code of Georgia Annotated, relating to
powers and duties of the Georgia Peace Officer Standards and Training Council
generally, so as to clarify the authority of the council to impose
administrative fees; to provide for related matters; to provide an effective
date; to repeal conflicting laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 35-8-7 of the Official Code of Georgia Annotated, relating to powers and
duties of the Georgia Peace Officer Standards and Training Council generally, is
amended by renumbering paragraphs 23 and 24 as paragraphs 24 and 25,
respectively, and adding a new paragraph to read as follows:
"(23)
To impose administrative fees, as determined by the council, for services
provided pursuant to the provisions of this
chapter;"
SECTION
2.
Nothing
contained in this Act shall be construed so as to suggest that any
administrative fees that may have been collected by the Georgia Peace Officer
Standards and Training Council prior to this Act's enactment were collected
without authority. Nor shall this Act be construed so as to create in any
person paying administrative fees prior to the effective date of this Act a
cause of action for the payment of such fees.
SECTION
3.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.

4.
All
laws and parts of laws in conflict with this Act are repealed.
