AS PASSED SENATE

A BILL TO BE ENTITLED
AN ACT


To provide that the chief magistrate of the Magistrate Court of Troup County shall be a full-time position; to provide for the compensation and qualifications for such chief magistrate; to repeal a certain local Act; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
The chief magistrate of the Magistrate Court of Troup County shall be a full-time position, and such chief magistrate shall devote his or her full time to the duties of such office.

SECTION 2.
The chief magistrate of the Magistrate Court of Troup County shall receive an annual salary in the amount of $95,000.00 to be paid in equal monthly or bimonthly installments from the funds of the county. The chief magistrate shall be entitled to be reimbursed for actual expenses incurred in the performance of his or her official duties in the same manner and rate as other county employees.

SECTION 3.
In addition to all other qualifications established by general law or applicable local legislation, no person shall be elected chief magistrate of the Magistrate Court of Troup County unless, at the time of his or her election, he or she is an attorney and member in good standing of the State Bar of Georgia.

SECTION 4.
An Act to provide for the compensation of the chief magistrate of the Magistrate Court of Troup County, approved March 18, 1985 (Ga. L. 1985, p. 3817), is hereby repealed.

SECTION 5.
This Act shall become effective on July 1, 2009.

SECTION 6.
All laws and parts of laws in conflict with this Act are repealed.
