BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 1 of Article 2 of Chapter 8 of Title 12 of the Official Code of
Georgia Annotated, relating to general provisions relative to solid waste
management, so as to change certain provisions relating to permits for municipal
solid waste landfill sites within two miles of a significant ground-water
recharge area; to provide an effective date; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
1 of Article 2 of Chapter 8 of Title 12 of the Official Code of Georgia
Annotated, relating to general provisions relative to solid waste management, is
amended by revising Code Section 12-8-25.2, relating to permits for municipal
solid waste landfill sites within two miles of a significant ground-water
recharge area, as follows:
"12-8-25.2.
No
permit shall be issued for a municipal solid waste landfill if any part of the
site is within two miles of an area that has been designated by the director as
a significant ground-water recharge area unless
such:
(1)
Such municipal solid waste landfill will
have a liner and leachate collection system and meets any other requirements as
may be established by rules and regulations of the board or pursuant to other
geological considerations as may be determined appropriate by the
director;
and
(2)(A)
The completed application for such permit was submitted prior to the effective
date of this paragraph; or
(B)
The completed application for such permit is submitted on or after July 1,
2016."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
