BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 36-80-16 of the Official Code of Georgia Annotated, the
"Local Government Authorities Registration Act," so as to provide for immunity
for local government authorities and such authorities' members, officers,
agents, and employees; to provide for related matters; to provide an effective
date; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 36-80-16 of the Official Code of Georgia Annotated, the "Local
Government Authorities Registration Act," is amended by adding a new subsection
to read as follows:
"(k)
A local government authority, regardless of whether such authority is
registered, shall have the same immunity and privileges from liability for
damages as provided to this state. The members, officers, agents, and employees
of each local government authority, when acting withing the scope of their work
for the local government authority, shall have the same immunity and privileges
from liability for damages as officials, officers, agents, and employees of this
state. Unless otherwise provided by law, the defense of sovereign immunity is
waived by local government authorities as to any action ex contractu for the
breach of any written contract. The immunity provided in this Code section
shall be in addition to any immunity provided by other provisions of law and
this subsection shall not be construed to limit or qualify any other immunity
provided to any local government authority or such authority's members,
officers, agents, or employees by any other provision of
law."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
