A RESOLUTION


Proposing an amendment to the Constitution so as to provide that the Public Service Commission shall be composed of seven members representing seven districts of more or less equal population who shall be elected by the qualified electors of their respective districts; to provide for terms of office; to provide for staggered terms; to provide for terms of office of the five members of the commission in office prior to January 1, 2014; to provide for submission of this amendment for ratification or rejection; and for other purposes.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article IV, Section I, Paragraph I of the Constitution is amended as follows:
"(a) There shall be a Public Service Commission for the regulation of utilities which shall consist of five members who shall be elected by the people and who shall serve through December 31, 2013, at which time their terms of office shall expire. Beginning January 1, 2014, there shall be a Public Service Commission for the regulation of utilities which shall consist of seven members representing seven districts of more or less equal population who shall be elected by the qualified electors of their respective districts. The initial seven members shall be elected at the general election in 2013 for terms of office beginning the first day of January following such election. The General Assembly shall by general law establish the initial terms of such members which shall not exceed six years and shall be staggered. The Commissioners in office on June 30, 1983, shall serve until December 31 after the general election at which the successor of each member is elected. Thereafter, all succeeding terms of members shall be for six years. Members shall serve until their successors are elected and qualified. A chairman chairperson shall be selected by the members of the commission from its membership.
(b) The commission shall be vested with such jurisdiction, powers, and duties as provided by law.
(c) The filling of vacancies and manner and time of election of members of the commission shall be as provided by law."
SECTION 2.
The above proposed amendment to the Constitution shall be published and submitted as provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the above proposed amendment shall have written or printed thereon the following:
"(  )  YES

(  )  NO

Shall the Constitution be amended so as to provide that the Public Service Commission shall be expanded from five members elected at large to seven members representing seven districts of more or less equal population who shall be elected by the qualified electors of their respective districts?"
All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." All persons desiring to vote against ratifying the proposed amendment shall vote "No." If such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
