A BILL TO BE ENTITLED
AN ACT


To amend an Act providing for the numbering of positions of membership on the Cherokee County Board of Education, approved April 17, 1973 (Ga. L. 1973, p. 3207), as amended, particularly by an Act approved March 18, 1980 (Ga. L. 1980, p. 3275), and by an Act approved April 25, 2002 (Ga. L. 2002, p. 4869), so as to revise the districts for the election of members of the board of education; to provide for definitions and inclusions; to provide for manner of election; to provide for submission of this Act for preclearance pursuant to Section 5 of the federal Voting Rights Act of 1965, as amended; to provide for related matters; to provide for effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act providing for the numbering of positions of membership on the Cherokee County Board of Education, approved April 17, 1973 (Ga. L. 1973, p. 3207), as amended, particularly by an Act approved March 18, 1980 (Ga. L. 1980, p. 3275), and by an Act approved April 25, 2002 (Ga. L. 2002, p. 4869), is amended by revising Sections 1 through 3 as follows:

"SECTION 1.
On and after January 1, 2013, the board of education of Cherokee County shall be composed of seven members. One member shall be elected by the voters of the entire Cherokee County School District at large and shall be the chairperson of the board. The other six members shall be elected by district. The chairperson may reside anywhere in the Cherokee County School District. In order to be a candidate for a district seat, a person shall be a resident of the district which he or she seeks to represent and shall remain a resident of such district while in office.

SECTION 2.
(a) For the purpose of electing the six district members to the Cherokee County Board of Education, the Cherokee County School District is divided into six education districts which shall be and correspond to those six numbered districts described in and attached to and made a part of this Act and further identified as 'Plan: chersb-2012 Plan Type: Local Administrator: Cherokee User: Gina'.
(b)(1) For the purposes of such plan:
(A) The term 'VTD' shall mean and describe the same geographical boundaries as provided in the report of the Bureau of the Census for the United States decennial census of 2010 for the State of Georgia. The separate numeric designations in a district description which are underneath a VTD heading shall mean and describe individual Blocks within a VTD as provided in the report of the Bureau of the Census for the United States decennial census of 2010 for the State of Georgia; and
(B) Except as otherwise provided in the description of any district, whenever the description of any district refers to a named city, it shall mean the geographical boundaries of that city as shown on the census maps for the United States decennial census of 2010 for the State of Georgia.
(2) Any part of the Cherokee County School District which is not included in any district described in subsection (a) of this section shall be included within that district contiguous to such part which contains the least population according to the United States decennial census of 2010 for the State of Georgia.
(3) Any part of the Cherokee County School District which is described in subsection (a) of this section as being included in a particular district shall nevertheless not be included within such district if such part is not contiguous to such district. Such noncontiguous part shall instead be included within that district contiguous to such part which contains the least population according to the United States decennial census of 2010 for the State of Georgia.

SECTION 3.
(a) Those members of the Board of Education of Cherokee County who are serving as such on the effective date of this section and any person selected to fill a vacancy in any such office shall continue to serve as such members until the regular expiration of their respective terms of office and upon the election and qualification of their respective successors.
(b) Beginning January 1, 2013, the member formerly representing Education District 1 shall be deemed to be representing new Education District 6 as described in Section 2 of this Act, the member formerly representing Education District 3 shall be deemed to be representing new Education District 3 as described in Section 2 of this Act, the member formerly representing Education District 5 shall be deemed to be representing new Education District 4 as described in Section 2 of this Act, and the member formerly representing Education District 6 shall be deemed to be representing new Education District 5 as described in Section 2 of this Act.
(c) In the 2012 elections, an election shall be held for the chairperson and for new Education Districts 1 and 2 as described in Section 2 of this Act who shall take office on January 1, 2013, for terms of four years and until their respective successors are elected and qualified.
(d) Successors to the members elected in 2012 and those members whose terms end in 2014 shall be elected at the general election immediately preceding the end of their terms of office and shall take office on January 1 immediately following such election for terms of office of four years and until their respective successors are elected and qualified."

SECTION 2.
The Board of Education of Cherokee County shall through its legal counsel cause this Act to be submitted for preclearance under Section 5 of the federal Voting Rights Act of 1965, as amended, not later than 30 days after the date on which this Act is approved by the Governor or otherwise becomes law without such approval.

SECTION 3.
This section, Section 2, and those provisions of this Act necessary to conduct elections in 2012 shall become effective upon this Act's approval by the Governor or upon its becoming law without such approval. The remaining provisions of this Act shall become effective on January 1, 2013.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
