BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act providing a new charter for the City of Carnesville, approved April
13, 2001 (Ga. L. 3834), as amended, particularly by an Act approved May 17, 2004
(Ga. L. 2004, p. 3606), so as to exchange the corporate boundaries of the city;
to repeal conflicting laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act providing a new charter for the City of Carnesville, approved April 13, 2001
(Ga. L. 3834), as amended, particularly by an Act approved May 17, 2004 (Ga. L.
2004, p. 3606), is amended by adding at the end of Section 1.11 a new subsection
to read as follows:
"(d)
In addition to the corporate boundaries described in subsections (a) and (c) of
this section, the corporate boundaries of the city shall include the following
described territory:
All
that tract or parcel of land, lying, situate and being in the 263rd G. M. D.,
Franklin County, Georgia, CONTAINING 8.555 acres, more or less, being designated
as State Route #320 being more clearly shown and delineated on a Survey for City
of Carnesville Springs by Bauknight & Associates, Inc., Registered Land
Surveyors, dated March 9, 2009. Said survey is hereby incorporated herein and
made a part hereof. Said acreage more particularly described as follows: TO
FIND THE TRUE POINT OF BEGINNING, begin at iron pin found 92.15 feet southeast
of the iron pin found at southwestern point of the property line shown as
Darrell W. Smith and the intersection of northeastern point of right-of-way of
State Route #320 for the TRUE POINT OF BEGINNING. FROM SAID TRUE POINT OF
BEGINNING, run northwesterly for 248.83 feet to iron pin found along the
property line shown as Darrell W. Smith; run thence northwesterly for 362.96
feet along the property line shown as Eveylyn Crane & Elora Stargel;
continue thence northwesterly 376.54 feet along the property line shown as
Eveylyn Crane & Elora Stargel; continue thence northwesterly following the
curvature thereof an arc distance of 290.81 feet along the properties shown as
Evelyn Crane & Elora Stargel and Jaunice Pryce, et al; continuing thence
northwesterly 1497.79 feet over Ginn Street and the properties shown as Edward
H. Roane and Joe Roane; continuing thence northwesterly following the curvature
thereof an arc distance of 315.62 feet along the property lines shown as Joe
Roane, Edward H. Raone and Linda Hancock to iron pin; continuing northwesterly
along the property line shown as Linda Hancock following the curvature thereof
an arc distance of 144.75 feet to iron pin found at the northwest corner of the
property shown as Linda Hancock and State Route #320; continuing thence
northwesterly along the properly line shown as Charles C. Dinsmore following the
curvature thereof of an arc distance of 165.41; continuing thence northwesterly
120.02 feet to iron pin found; continuing thence northwesterly 58.55 feet; run
thence northeast 40.26 feet; run thence northwesterly 253.90 feet along the
property line shown as Phillip & Christie Chan; thence northwesterly along
the property line shown as Blue Water Partners Inc for 199.03 feet; thence
northwesterly 51.18 feet to iron pin found; thence northeasterly 97.70 feet to
intersection of the northeastern right-of-way of State Route 320 and the
property line shown as Blue Water Partners Inc.; run thence southwesterly 245.20
feet to the intersection of the right-of-way of State Route #320 and property
shown as Sunshine Travel Center, LLC; continuing thence southeasterly 79.20
feet; continuing thence 350.10 feet along the property line shown as Sunshine
Travel Center, LLC; continuing southeasterly 209.40 feet to concrete marker; run
thence northeasterly to concrete marker 20.55 feet; run thence southeasterly
179.66 feet; run thence southeasterly following the curvature thereof an arc
distance of 300.61 feet along the property shown as TJJ Investment Service, LLC
and over County Road #209 and along the property line shown as H. Gene
Strickland; run thence southeasterly following the curvature thereof an arc
distance of 309.67 feet along the property lines shown as H. Gene Strickland and
Albert D. Cisson; run thence southeasterly 1497.47 feet along the property lines
shown as Joe Strickland, Linda & Archie Mauldin, Alan R. Dickinson and
Jaunice Pryce, et al; run thence southeasterly following the curvature thereof
an arc distance of 288.66 feet along the property line shown as Adams H R
Properties, LP; run thence southeasterly 375.88 feet along the property lines
shown as Adams H R Properties, LP, Joyce McElroy and Harold Moore; continuing
thence southeasterly 362.74 feet along the property lines shown as Harold Moore
and Adams H R Properties, LP; continuing thence southeasterly 249.04 feet to the
southern point of right-of-way of State Route #320; run thence northeasterly
80.00 feet to iron pin found being point of beginning. Said tract contains
8.555 acres more or less."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
