BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 11 of Chapter 6 of Title 40 of the Official Code of Georgia
Annotated, relating to miscellaneous provisions of the uniform rules of the
road, so as to require owners of vehicles used to transport aggregate materials
to clearly identify their vehicles; to provide for related matters; to provide
for an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
11 of Chapter 6 of Title 40 of the Official Code of Georgia Annotated, relating
to miscellaneous provisions of the uniform rules of the road, is amended by
adding a new Code section as follows:
"40-6-248.2.
(a)
As used in this Code section, the term 'aggregate material' means rock
fragments, pebbles, sand, dirt, gravel, crushed stone, fill dirt, borrow pit
materials, plant mix road materials, plant mix concrete, cobbles, crushed base,
and other similar materials. 'Aggregate material' does not include hot asphalt,
including asphalt patching material, wet concrete, or other materials not
susceptible to blowing.
(b)
The owner of any dump truck, transit mixer, or other similar vehicle used in the
transportation of aggregate material shall clearly and distinctly mark such
vehicle so that it is readily identifiable in case the vehicle or its contents
cause any damage to other users of the public highways of this
state.
(c)
This Code section shall not apply to a vehicle:
(1)
Operated entirely and exclusively within a marked construction
zone;
(2)
Involved in maintenance of public roads; or
(3)
Involved in emergency operations when requested by a law enforcement agency or
officer."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
