A BILL TO BE ENTITLED
AN ACT


To amend an Act creating a new charter for the City of Garden City, approved April 17, 1973 (Ga. L. 1973, p. 3581), as amended, particularly by an Act approved March 27, 1998 (Ga. L. 1998, p. 3865), so as to deannex certain property from such city's corporate limits; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act creating a new charter for the City of Garden City, approved April 17, 1973 (Ga. L. 1973, p. 3581), as amended, particularly by an Act approved March 27, 1998 (Ga. L. 1998, p. 3865), is amended in Section 1.11 by adding a new subsection to read as follows:
"(j) Notwithstanding any other provision of this Act to the contrary, the corporate limits of Garden City shall specifically not include the following described property:
PARCEL 1:
All that tract or parcel of land situate, lying and being in the 7th G.M.D., Garden City, Chatham County, Georgia, and being more particularly described as follows:
Commencing at a point at the intersection of the eastern right-of-way line of U.S. Highway 17(S.R. 25) and the southern right-of-way line of Pipemakers Canal, said point being also the Point of Beginning; thence running in a easterly direction, N 77°34'27" E, a distance of 1365.36 feet to a point, said point being a CMF (concrete monument found); thence running in a southerly direction, S 01°33'39" E, a distance of 837.66 feet to a point; thence S 05°59'47" W, a distance of 2081.16 feet to a point, said point being a CMF; thence S10°04'45" W, a distance of 925.44 feet to a point; thence running in a westerly direction along a curve to the right having a radius distance of 443.06 feet, an arc distance of 287.48 feet, a chord bearing of S 66°15'22" W, and a chord distance of 282.46 feet to a point; thence running in a northerly direction along said right-of-way of U.S. Highway 17 along a curve to the left having a radius distance of 1893.53 feet, an arc distance of 593.89 feet, a chord bearing of N 01°29'02" W, and a chord distance of 591.46 feet to a point; thence N 09°21'34" W, a distance of 1197.81 feet to a point, said point being a CMF; thence along a curve to the left having a radius distance of 2310.00 feet, an arc distance of 300.18 feet, a chord bearing of N 11°54'17" W, and a chord distance of 299.97 feet to a point, said point being an IRF (iron rod found); thence 16°48'00" W, a distance of 1186.03 feet to a point, said point being an IRF; thence N 76°57'00" E, a distance of 27.06 feet to a point; thence N 16°48'00" W, a distance of 449.23 feet to a point, said point being the same Point of Beginning.
The above description being a 67.80 acre compilation of Lots 1 through 34, Parcels A, B and C, and a portion of right-of-ways of Smith Avenue and Blackburn Avenue, Industrial City Gardens, Garden City, Georgia, and being bounded on the north by Pipemakers Canal, on the East by Lands of Georgia Ports Authority (Railroad Yard), and on the south by Seaboard Coastline Railroad.

PARCEL 2:
ALL that certain lot, tract or parcel of land situate, lying and being in the City of Garden City, in Chatham County, Georgia, and being more particularly described as follows: Beginning at the intersection of the easterly right-of-way line of U.S. Highway No. 25 (formerly Highway No. 17), and the northern right-of-way line of property formerly owned by the Savannah Warehouse & Compress Company's East Track; proceeding thence North 06° 05' 50" East a distance of 442.5 feet along said eastern right-of-way line of U.S. Highway No 25; proceeding thence easterly along the curve of the southern right-of-way line of the Savannah & Atlanta Railroad Spur to property formerly owned by the Savannah Warehouse & Compress Company to a point which is North 71° 20' 55" East 275.6 feet from the immediate preceding points; proceeding thence South 30° 12' 20" West a distance of 612 feet along the northern right-of-way line of property now or formerly owned by the Savannah Warehouse & Compress Company's East Track to the point of beginning and containing 1.06 acres more or less. The above described parcel has been referred to as Lot 7 of Industrial Subdivision of the Savannah Warehouse & Compress Company Tract."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
