AN ACT
AN ACT
To
amend an Act providing for the continued existence of the Wilcox County School
District and the Wilcox County Board of Education, approved March 30, 1989 (Ga.
L. 1989, p. 4452), as amended, particularly by an Act approved May 13,
2002 (Ga. L. 2002, p. 5789), so as to provide for staggered terms
for members of the board of education; to provide for continuation in office of
certain members; to provide for election and terms of office for subsequent
members; to provide for submission of this Act under Section 5 of the federal
Voting Rights Act of 1965, as amended; to provide for an effective date; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act providing for the continued existence of the Wilcox County School District
and the Wilcox County Board of Education, approved March 30, 1989 (Ga.
L. 1989, p. 4452), as amended, particularly by an Act approved May 13,
2002 (Ga. L. 2002, p. 5789), is amended by revising subsections
(a) and (b) of Section 4 as follows:
"(a)
The members from Districts 1, 3, and 5 shall be elected at the general election
on the Tuesday next following the first Monday in November, 2010. Those members
of the board elected thereto from Districts 1, 3, and 5 in 2010 shall take
office on the first day of January immediately following that election and shall
serve for initial terms of office which expire December 31, 2014, and upon the
election and qualification of their respective successors. The members from
Districts 2 and 4 shall be elected at the general election on the Tuesday next
following the first Monday in November, 2010. Those members of the board
elected thereto from Districts 2 and 4 hall take office on the first day of
January immediately following that election and shall serve for initial terms of
office which expire December 31, 2016, and upon the election and qualification
of their respective successors. Those and all future successors to members of
the board whose terms of office are to expire shall be elected at the time of
the statewide general election immediately preceding the expiration of such
terms, shall take office on the first day of January immediately following that
election, and shall serve for terms of office for four years each. Members of
the board shall serve for the terms of office specified therefor in this
subsection and until their respective successors are elected and
qualified.
(b)
Districts 1, 2, 3, 4, and 5, as they existed on December 31, 2008, shall
continue to be designated as Districts 1, 2, 3, 4, and 5, respectively, and
shall remain as described under that certain Act approved May 13, 2002
(Ga. L. 2002, p. 5789), and such members of the board serving
their respective districts on December 31, 2008, shall remain in office and
shall be deemed to be serving their respective districts until their successors
are elected and qualified as herein provided."
SECTION
2.
It
shall be the duty of the Board of Education of Wilcox County, through its legal
counsel, to submit this Act for preclearance under Section 5 of the federal
Voting Rights Act of 1965, as amended, not later than 60 days after the date on
which this Act is approved by the Governor or otherwise becomes law without such
approval.
SECTION
3.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
