BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act to provide for continued insurance coverage for certain former
members of the board of commissioners of Whitfield County, certain former county
officers of Whitfield County, and certain spouses and eligible dependents
thereof, approved March 28, 1990 (Ga. L. 1990, p. 4663), so as to provide that
the authorization to elect continued group health insurance coverage of those
members, officers, and the spouses and eligible dependents of those individuals
employed or elected on or after the effective date of this Act shall no longer
be available to such individuals once they are no longer serving as members or
officers; to provide for an effective date; to provide for related matters; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act to provide for continued insurance coverage for certain former members of
the board of commissioners of Whitfield County, certain former county officers
of Whitfield County, and certain spouses and eligible dependents thereof,
approved March 28, 1990 (Ga. L. 1990, p. 4663), is amended by revising Section 1
as follows:
"SECTION
1.
(a)
All former members of the board of commissioners of Whitfield County, all former
constitutional county officers of Whitfield County as specified in Article IX,
Section I, Paragraph III(a) of the Constitution, and the spouses and eligible
dependents of such former or deceased members or officers who participated in
group health insurance coverage during the term of office of such member or
officer shall, upon written request to the governing authority of Whitfield
County, be authorized to continue to receive such insurance coverage, except as
provided in subsections (b) and (c) of this section. Any such insured person
shall pay the entire cost of the premium for such coverage and shall reimburse
Whitfield County for any expense incurred by such county in the provision of
such insurance coverage.
(b)
All former members of the board of commissioners of Whitfield County, all former
constitutional county officers of Whitfield County as specified in Article IX,
Section I, Paragraph III(a) of the Constitution, and the spouses and eligible
dependents of such former or deceased members or officers who participated in
group health insurance coverage during the term of office of such member or
officer and who chose to continue to receive such insurance coverage pursuant to
subsection (a) of this section, upon reaching 65 years of age or older or
otherwise becoming medicare eligible, shall not be authorized to continue to
receive such insurance coverage.
(c)
All members of the board of commissioners of Whitfield County and all
constitutional county officers of Whitfield County as specified in Article IX,
Section I, Paragraph III(a) of the Constitution taking office on or after the
effective date of this Act, and the spouses and eligible dependents of such
members or officers who participate in group health insurance, shall not be
authorized to continue to receive such insurance coverage after such member or
officer is no longer serving in his or her capacity as a member of the board of
commissioners or as a county officer."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
