BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 10-1-357 of the Official Code of Georgia Annotated, relating
to penalties for violations of provisions pertaining to secondary metals
recyclers, so as to provide for the forfeiture of vehicles used to transport
stolen metals; to provide for related matters; to provide for an effective date
and applicability; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 10-1-357 of the Official Code of Georgia Annotated, relating to
penalties for violations of provisions pertaining to secondary metals recyclers,
is amended by adding a new subsection as follows:
"(c)
Any motor vehicle used to transport ferrous or nonferrous metals or regulated
metal property in violation of any provision of this article or in violation of
any provision of Code Sections 16-8-2 through 16-8-9 is declared to be
contraband and subject to forfeiture to the state. Forfeiture shall be
conducted in accordance with the procedures set forth in subsections (b) through
(g) of Code Section 40-6-391.2, relating to the seizure and forfeiture of motor
vehicles operated by habitual
violators."
SECTION
2.
This
Act shall become effective on July 1, 2009, and shall apply to all violations
occurring on or after such date.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
