BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act entitled "An Act to create a new charter for the City of Suwanee,"
approved April 9, 1999 (Ga. L. 1999, p. 3729), as amended, so as to provide that
the term of any elected city official shall be declared vacant upon the occupant
of such office qualifying for election to another office; to provide that
municipal officers shall be elected by majority vote; to provide for
applicability; to provide for submission for preclearance under Section 5 of the
federal Voting Rights Act of 1965, as amended; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act entitled "An Act to create a new charter for the City of Suwanee," approved
April 9, 1999 (Ga. L. 1999, p. 3729), as amended, is amended by revising
subsection (f) of Section 2.14 as follows:
"(f)
Political activities
of certain elected officials, appointed officers, and
employees. No appointed officer and no
employee of the city shall continue in such employment upon qualifying as a
candidate for nomination or election to any public office. The office of any
elected official shall be declared vacant upon such elected official qualifying
in a general primary or general election, or special primary or special
election, for another state, county, or municipal office or qualifying for the
House of Representatives or the Senate of the United States if the term of the
office for which such official is qualifying begins more than 30 days prior to
the expiration of such official's present term of office."
SECTION
2.
Said
Act is further amended by revising Section 5.11 as follows:

5.11.
Election by majority.
Election by majority.
The
person receiving a majority of the votes cast for any city office shall be
elected. If no candidate receives a majority of the votes cast, a runoff
election shall be held between the two candidates receiving the highest number
of votes. The runoff election shall be held as provided by law.
SECTION
3.
The
governing authority of the City of Suwanee shall cause, through its legal
counsel, this Act to be submitted for preclearance under Section 5 of the
federal Voting Rights Act of 1965, as amended, within 45 days after the date on
which this Act is approved by the Governor or otherwise becomes law without such
approval.
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
