A BILL TO BE ENTITLED
AN ACT


To amend Code Section 50-18-72 of the Official Code of Georgia Annotated, relating to when public disclosure not required and disclosure of exempting legal authority, so as to require government disclosure of a real estate purchase price under certain circumstances; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 50-18-72 of the Official Code of Georgia Annotated, relating to when public disclosure not required and disclosure of exempting legal authority, is amended by revising paragraph (6) of subsection (a) as follows:
"(6)(A) Real estate appraisals, engineering or feasibility estimates, or other records made for or by the state or a local agency relative to the acquisition of real property until such time as the property has been acquired or the proposed transaction has been terminated or abandoned; provided, however, that public disclosure of any proposed purchase price in a pending acquisition of real property shall be required at such time as an offer is made by a state or local agency; and
(B) Engineers' cost estimates and pending, rejected, or deferred bids or proposals until such time as the final award of the contract is made or the project is terminated or abandoned. The provisions of this subparagraph shall apply whether the bid or proposal is received or prepared by the Department of Transportation pursuant to Article 4 of Chapter 2 of Title 32, by a county pursuant to Article 3 of Chapter 4 of Title 32, by a municipality pursuant to Article 4 of Chapter 4 of Title 32, or by a governmental entity pursuant to Article 2 of Chapter 91 of Title 36. The provisions of this subparagraph shall not apply to a bid amount made by a state or local agency for the purchase of real property. The amount of any proposed purchase price for real property submitted by a state or local agency in any bid or proposal shall be subject to public disclosure at the time such bid is made;"
SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
