BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 40-8-7 of the Official Code of Georgia Annotated, relating to
driving unsafe or improperly equipped vehicles, so as to define a term; to make
driving a vehicle with snow or ice on it an unsafe condition under certain
circumstances; to provide for related matters; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 40-8-7 of the Official Code of Georgia Annotated, relating to driving
unsafe or improperly equipped vehicles, is amended by revising subsection (b) as
follows:
"(b)
It is a misdemeanor for any person to drive or move, or for the owner to cause
or knowingly permit to be driven or moved, on any street or highway any vehicle
or combination of vehicles:
(1)
Which is in such unsafe condition as to endanger any
person,
including but not limited to driving a vehicle which has snow or ice on it such
that it obstructs the driver's view or such that the snow or ice falls off the
vehicle on any street or highway and endangers any
person;
(2)
Which does not contain those parts or is not at all times equipped with such
lights and other equipment in proper condition and adjustment as required in
this chapter; or
(3)
Which is equipped in any manner in violation of this chapter."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
