BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating
to incorporation of municipal corporations, so as to provide that a municipality
created on and after July 1, 2010, which immediately prior to incorporation was
a part of a county special services district may be authorized to continue
beyond the transition period to receive certain services from the county in the
same manner as such area received the services prior to incorporation upon the
payment by the city of the actual cost of providing such service or function
unless otherwise provided in a written agreement between the new city and the
county; to provide for related matters; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
31 of Title 36 of the Official Code of Georgia Annotated, relating to
incorporation of municipal corporations, is amended by revising Code Section
36-31-8, relating to transition periods for governmental functions, by adding a
new subsection to read as follows:
"(h)
Notwithstanding any provision of Chapter 70 of this title, in the case of a
municipality that is created on and after July 1, 2010, the territory of which
immediately prior to incorporation was a part of a county special services
district, the chartering local Act may authorize such municipality to continue
beyond the transition period to receive certain services as specified in such
chartering local Act from the county in the same manner as such area received
the services prior to incorporation upon the payment by the city of the actual
cost of providing such service or function unless otherwise provided in a
written agreement between the new city and the
county."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
