The House Committee on Regulated Industries offers the following substitute to
HB 1269:

A BILL TO BE ENTITLED
AN ACT

To amend Article 2 of Chapter 3 of Title 3 of the Official Code of Georgia Annotated, relating to prohibited acts relative to alcoholic beverages, so as to define a certain term; to provide that the sale or purchase of caffeinated alcoholic beverages shall be prohibited in this state; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 2 of Chapter 3 of Title 3 of the Official Code of Georgia Annotated, relating to prohibited acts relative to alcoholic beverages, is amended by adding a new Code section to read as follows:
"3-3-34.
(a) As used in this Code section, the term 'caffeinated alcoholic beverage' means a presealed beverage in an individual serving container containing caffeine and at least one-half of 1 percent of alcohol by volume.
(b) No person shall sell, offer for sale, or purchase any caffeinated alcoholic beverage in this state."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
