A BILL TO BE ENTITLED
AN ACT


To amend Part 7 of Article 7 of Chapter 3 of Title 20 of the Official Code of Georgia Annotated, relating to HOPE scholarships and grants, so as to provide for a scholarship for attending out-of-state institutions; to provide for forgiving repayment of such scholarships for students who return to this state; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 7 of Article 7 of Chapter 3 of Title 20 of the Official Code of Georgia Annotated, relating to HOPE scholarships and grants, is amended by revising Code Section 20-3-519.12, which is reserved, as follows:
"20-3-519.12.
(a) As used in this Code section, the term 'qualified out-of-state institution' means a nonproprietary institution of higher education located in a state other than this state which has received accreditation by a national or regional accrediting agency recognized by the United States Department of Education.
(b) Any person who has an unweighted cumulative grade point average of 3.8 or higher and who is otherwise eligible for a scholarship under this part shall be eligible to receive a scholarship to attend a qualified out-of-state institution. Such person shall be excused from repayment of such scholarship if he or she returns to reside in this state on a full-time basis on a schedule of $15,000.00 forgiven for each year of residence, which may be calculated on a quarterly basis."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
