151st GENERAL ASSEMBLY

SENATE RESOLUTION NO. 22

CONDEMNING THE FEDERAL ACTION AGAINST PARENTS AND REAFFIRMING PARENTS’ RIGHTS TO BRING GRIEVANCES TO SCHOOL BOARDS.

WHEREAS, on October 4, 2021, Attorney General Merrick Garland, sent a memorandum directing federal law enforcement to partner with state and local governments to address “threats of violence, and other forms of intimidation and harassment” of “school administrators, board members, teachers, and staff” in public schools; and

WHEREAS, the rhetoric expressed in the memorandum does not accurately reflect the reality of what is occurring nationally and in Delaware; and

WHEREAS, the national grassroots interest we are seeing by parents is to be commended and encouraged; and

WHEREAS, parents of children in school have the right to peacefully express their opinions about what is being taught in the classroom; and

WHEREAS, violence and threats of violence at school board meetings have been isolated and dealt with appropriately by local law enforcement; and

WHEREAS, Amendment 1 of the United States Constitution guarantees, in part, “the right of the people to peacefully assemble, and to petition the Government for a redress of grievances”; and

WHEREAS, federal law enforcement should not have the ability to stifle protected speech.

NOW, THEREFORE:

BE IT RESOLVED by the Senate of the 151 st General Assembly of the State Delaware that the Senate condemns federal action against parents’ rights to bring grievances to school boards.

BE IT FURTHER RESOLVED that the Senate strongly condemns violence, threats of violence, harassment, and intimidation.

BE IT FURTHER RESOLVED that the Senate supports the rights of parents to peacefully assemble, speak freely, and petition the government, including local school boards on any topic.

SYNOPSIS

This Resolution condemns the federal action against parents and reaffirms parents' rights to bring grievances to school boards.
