146th GENERAL ASSEMBLY

SENATE RESOLUTION NO. 11

SUPPORTING THE FEDERAL FOOD SAFETY MODERNIZATION ACT.



WHEREAS, the U.S. Congress has passed and the President has signed the Food Safety Modernization Act ("FSMA"), and

WHEREAS, said Act authorizes The Food and Drug Administration to recall tainted food that may cause sickness and disease, and

WHEREAS, the said Act requires food producers to develop safety plans in the event of an emergency, and

WHEREAS, the said Act requires the Health and Human Services Department to create food tracing systems, and

WHEREAS, said Act requires food importers to verify U.S. safety standards are met.

WHEREAS, said Act calls on the federal government to create, and make available to Local Education Agencies (LEAs), food allergy management guidance materials applicable for early childhood education programs, public kindergartens, public elementary schools, and public secondary schools.

NOW THEREFORE:

BE IT RESOLVED that the Delaware Senate supports this Act and its implementation to help prevent sickness and disease from tainted food.

BE IT FURTHER RESOLVED that the Delaware State Senate encourages Local Education Agencies (LEAs) in Delaware to adopt and implement food allergy management policies consistent with the guidance materials published by the federal government in accordance with the Act.


SYNOPSIS

This resolution supports the intent and law created in the federal Food Safety Modernization Act. Simply, the bill is a good step in protecting people from tainted, processed food and the Delaware Senate supports that legislation.
