148th GENERAL ASSEMBLY

SENATE BILL NO. 70

AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF PROPERTY FROM THE APPOQUINIMINK SCHOOL DISTRICT TO THE TOWN OF TOWNSEND.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):


Section 1.Notwithstanding the provisions of 14 Del. C. §1057, the Appoquinimink School District is authorized to convey 3.70 acres of land at 200 Finley Street, Townsend, Delaware 19734 (New Castle County tax parcel ID number 2500400054) to the Town of Townsend for the consideration of one dollar ($1.00).The deed to the aforesaid real property shall contain a provision whereby the Appoquinimink School District shall have the right of first refusal to the property in the event the Town of Townsend wishes to vacate the property.If the Appoquinimink School District does not exercise its right of first refusal, proceeds from the sale of said property directly related to the value of the land minus capital improvements borne by the Town of Townsend shall accrue to the Appoquinimink School District and be governed by the provisions of14 Del. C. §1057(a)(15).The Town of Townsend shall be liable for the payment of transaction costs associated with the property conveyance as well as placing an historical marker on the site indicating the property's historic significance to the community.

Section 2.The Town of Townsend receives the property in "as is" condition.


SYNOPSIS

This bill provides for the transfer of property from the Appoquinimink School District to the Town of Townsend.
