SENATE BILL NO. 7

AN ACT TO AMEND CHAPTER 33, TITLE 19 OF THE DELAWARE CODE RELATING TO UNEMPLOYMENT COMPENSATION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend § 3326 (a) (2) (c) 2., Title 19 of the Delaware Code by deleting the "." as it appears after the word "years" therein, and in its place inserting the following:

";however, for weeks of compensation beginning after December 17, 2010, and ending December 31, 2011, or the expiration date set forth in Public Law 111-312, whichever is later, the average rate of total unemployment in the State (seasonally adjusted), as determined by the United States Secretary of Labor, for the 3-month period referred to in clause 1, equals or exceeds 110 percent of such average for any or all of the corresponding 3-month periods ending in the 3 preceding calendar years."

Section 2. Upon enactment, this legislation shall be effective retroactive to December 18, 2010.


SYNOPSIS

This Act establishes a three year "look-back" for the TUR (total Unemployment Rate) trigger for EB (Extended Benefits) retroactive to December 18, 2010.Under the current two year look-back TUR trigger, the State will most likely trigger off EB in April of CY 2011 and long-term unemployed individuals would no longer be eligible for these 100.0% federally funded benefits.
