AN ACT PROPOSING AN AMENDMENT TO THE DELAWARE CONSTITUTION RELATING TO GEOGRAPHICAL BALANCE WITHIN THE JUDICIARY. |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
AMEND Article III §3 of the Delaware Constitution by making deletions as shown by strike through and insertions as shown by underline as follows:
Seventh, so as to ensure traditional geographic balance within the judiciary, the Supreme Court and the Chancery Court shall at all times each include within their membership at least one member resident of each of the three counties at the time of their appointment and at least 2 years immediately prior thereto.
SYNOPSIS
Traditionally, at least one member of both the Court of Chancery and the Supreme Court have been residents of and been appointed from the Bars of each of the three counties, respectively.This Amendment is the 1st leg of a Constitutional Amendment to formalize that tradition and practice. |
