DELAWARE STATE SENATE

148th GENERAL ASSEMBLY

SENATE BILL NO. 299

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DIVISION OF LONG-TERM CARE RESIDENTS PROTECTION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend Subchapter VI, Chapter 79, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§7971. Division of Long-Term Care Residents Protection.

(d) The Division shall have the following duties and functions:

(3) Receive and investigate complaints of abuse, neglect, mistreatment, financial exploitation and other concerns which may adversely affect the health, safety, welfare or rights of such individuals including alleged violations of federal and state statutes and regulations and in connection with such duties and functions shall have the authority to obtain an individual's hospital, emergency medical system, and paramedic records in cases where the Division is engaged in an investigation or survey involving the care or treatment of the individual at a facility licensed by the Division, and the individual has been transported to or from a hospital or admitted to a hospital from the facility or discharged from a hospital to the facility;

(17) Develop a form for exchange of information between health care agencies and facilities regarding resident or patient health conditions and care needs to ensure ongoing quality of care and resident- or patient-centered care for the resident or patient in any care setting. This form shall be known as the Interagency Transfer Form.


SYNOPSIS

This Act provides additional safeguards for vulnerable individuals living in long-term care facilities and clarifies existing requirements. Specifically, this Act clarifies that the records to which the Division of Long-Term Care Residents Protection is entitled to access during an investigation involving the care or treatment of a resident include emergency medical system and paramedic records. It also requires the Division to develop a standardized form, the "Interagency Transfer Form," which health care agencies and facilities are required to exchange when a resident or patient is being transferred from one setting to another.
