SENATE BILL NO. 209

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO JURISDICTION OVER OFFENSES RELATING TO THE STATE GAMBLING EXCLUSION LISTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section1. Amend § 4811, Title 29 of the Delaware Code by making insertions as shown by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 4811. Jurisdiction in Superior Court.

The Superior Court has exclusive jurisdiction over offenses under this subchapter, except for offenses under

§ 4810(a) and § 4836 of this title.

SYNOPSIS

This Act removes the exclusive jurisdiction of the Superior Court for offenses under § 4836 of this Title on the basis of the voluntary and involuntary exclusion lists. This would allow the Court of Common Pleas to hold jurisdiction over these offenses as these are class A misdemeanor offenses.
