AN ACT TO AMEND TITLE 6 OF THE DELAWARE CODE RELATING TO DISTRIBUTION OF CERTAIN SOLICITATIONS. |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1.Amend Subchapter I, Chapter 25, Title 6, Delaware Code by making insertions as shown by underlining and deletions as shown by strike through as follows:
§505A.Prohibiting Weighted Advertisements and Business Solicitations
(a)No person shall distribute any advertisement or business solicitation on any residential property if the advertisement or business solicitation is weighted with rock(s), stone(s) or other such material.
(b)Weighted material shall not include material used to keep the advertisement or business solicitation intact and/or dry such as plastic wrapping and rubber bands.
(c)Each violation of this section shall be subject to a $50 fine.
(d)The Justice of the Peace Court shall have jurisdiction over violations of this section.
SYNOPSIS
The use of rocks or stones to allow advertisements and business solicitations greater distance when thrown on residential properties has become a concern due to the damage they can cause to private property, including vehicles in driveways.This Act seeks to prohibit the use of such weighted material. |
