AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO THE STATE BUREAU OF IDENTIFICATION. |
Section 1.Amend §8595(a)(4), Title 11 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
If
the review pursuant to subsection (a)(3) of this section identifies a conflict
between the name the applicant provided and an alias on file with the state, or
the applicant has an outstanding warrant for criminal charges in Delaware, a
federal criminal history check will be required. The Federal the
applicant's fingerprints and other necessary information will be sent by the
Bureau to the Federal Bureau of Investigation for a national background
check.This national background check
shall be comprised of a report of the applicant's entire federal criminal
history record, pursuant to the Federal Bureau of Investigation appropriation
of Title 42 of Public Law 92-544 (28 CFR §20.33 (a)(3)).The Bureau shall be the recipients of said
federal criminal history records.All
costs associated with obtaining the criminal history reports required by this
subsection shall be borne by the applicant.The applicant must resolve the conflict prior to becoming eligible to
obtain a Driving Privilege Card.
SYNOPSIS

This legislation corrects a technical error in Senate Bill 59 of the 148th General Assembly.The Federal Bureau of Investigation has informed the State Bureau of Identification that the FBI will not accept applicants' fingerprints unless the state-level statute specifically refers to "fingerprints."This legislation makes that correction to the Delaware Code and enables the original intent of the legislation to be realized.
