SENATE BILL NO. 128 |
AN ACT TO AMEND TITLE 23 OF THE DELAWARE CODE RELATING TO THE INCREASE OF FEES CHARGED FOR VESSEL REGISTRATIONS. |
WHEREAS, The Secretary of the Department of Natural Resources and Environmental Control is consolidating its law-enforcement officers from the Divisions of Parks and Recreation, and Fish and Wildlife to the Department's Office of Community Services and shall be referred to collectively as "Natural Resources Law-Enforcement Officers," as of July 1, 2011, pursuant to the authority in 29 Del. C. §8003(4); and
WHEREAS, it is the intent of the General Assembly that the Department of Natural Resources and Environmental Control and the Office of Management and Budget work together to develop an action plan/report regarding Natural Resources Law-Enforcement Officer retention and salary issues that were brought to the General Assembly's attention; and
WHEREAS, in anticipation of the action plan/report, any increase in revenue relative to increased fees for Boating Registrations shall be deposited in an interest bearing account and designated for future use to fund increases in Natural Resources Law-Enforcement Officer salaries;
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fifths of all members elected to each house thereof concurring therein):
Section 1.Amend §113(a), Title 23, Delaware Code, by deleting the numbers "10", "20", "30", "50", and "60", and by replacing them sequentially with "20", "30", "40", "60", and "70".
Section 2.Amend §113, Title 23, Delaware Code, by adding a new subsection (g) to read as follows:
"Beginning July 1, 2011 and annually thereafter, the funds derived by the State from the $10 increase to each vessel class for vessel/boat registrations shall be deposited as Appropriated Special Funds, in an interest bearing account, by the Department with the State Treasurer.Further, these funds shall be designated for future increases in Natural Resources Law-Enforcement Officer salaries.Any expenditure from these funds must be approved by the General Assembly."
Section 3. The Department of Natural Resources and Environmental Control and the Office of Management of Budget shall develop an action plan/report regarding Natural Resources law enforcement officer retention and safety issues and shall present its report to the Joint Finance Committee not later than January 31, 2012.
SYNOPSIS
This Bill recognizes the consolidation of the Department of Natural Resources and Environmental Control Law-Enforcement Officers under the Office of Community Services.It also directs DNREC and the Office of Management and Budget to develop an action plan/report regarding the salary and retention issues relative to Natural Resources law-enforcement officers.The increased fees collected under the amendments to Title 23 of this Bill create an Appropriated Special Fund for future use to fund increases in Natural Resources law-enforcement officer salaries, subject to approval by the General Assembly. |
