DELAWARE STATE SENATE

SENATE BILL NO. 127

AN ACT TO AMEND TITLE 31 OF THE DELAWARE CODE RELATING TO THE CHILD PLACEMENT REVIEW ACT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §3801, Title 31 of the Delaware Code by deleting the section in its entirety and inserting therein a new section as follows:

"Establishing an independent voluntary, citizen organization whose mission is to advocate on behalf of Delaware's children in out-of-home placements and to identify and periodically review children in the care and custody of a placement agency is in the best interests of the health and welfare of all citizens of Delaware. The purposes of this chapter are to provide a citizen-based independent monitoring of Delaware children in the care and custody of a placement agency to ensure that they receive continuing efforts to obtain permanent homes; adequate provision for their stability, health, and safety; and ongoing care addressing their physical, mental, and emotional needs; and to advocate as necessary for the paramount concerns of best interest and safety for the children."

Section 2.Amend §3805(1), Title 31 of the Delaware Code by deleting the word "facilitating" and inserting the word "advocating."

Section 3.Amend §3805(5), Title 31 of the Delaware Code by deleting the subsection in its entirety and renumbering the subsection accordingly.

Section 4.Amend §3808(1), Title 31 of the Delaware Code by inserting "attorney Guardian Ad Litems," after the phrase ""the child," and before the phrase "the Court Appointed Special Advocate,".

Section 5.Amend §3808(4), Title 31 of the Delaware Code by deleting the entire subsection and renumbering the subsections accordingly.

Section 6.Amend §3808(9), Title 31 of the Delaware Code by deleting the phrase "Develop and produce" and inserting the phrase "Prepare and approve".

Section 7.Amend §3809(7), Title 31 of the Delaware Code by deleting the word "assuring"and inserting therein the phrase "achieving permanency for the child andpromoting".

Section 8.Amend §3810(4), Title 31 of the Delaware Code by deleting the word "facilitate" and inserting the words "advocate for".

Section 9.Amend §3810(5), Title 31 of the Delaware Code by deleting the word "facilitate" and inserting the words "advocate for".

SYNOPSIS

This Bill is a result of recommendations made by the Joint Sunset Committee following its review of the Child Placement Review Board.The Bill incorporates changes in language to more accurately reflect the purpose, powers and duties, and role of the Board, the Executive Committee and the Executive Director.
