SENATE BILL NO. 113

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO REGULATION OF VEHICLE SPEEDS IN SCHOOL ZONES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend §101(84), Title 21 of the Delaware Code by striking "immediately before or after a scheduled school day" and inserting in lieu thereof "immediately before, during or immediately after a scheduled school day.".


SYNOPSIS

This bill clarifies the definition of "when children are present," as used on signage indicating a reduced speed school zone, to ensure that the speed limitation is in effect at appropriate times. The revised definition would ensure that the speed restriction would be in effect at times during the school day, as well as before and after the school day, when children are physically present along the roadway.
