HOUSE RESOLUTION NO. 37

CREATING THE DELAWARE SCHOOL CONSTRUCTION WORKING GROUP



WHEREAS, the Department of Education is required to calculate a voluntary school assessment pursuant to 14 Del. C. §103(c) and establish a school construction cost formula pursuant to 14 Del. C. §2002;

WHEREAS, the school construction cost formula and other school construction cost data is reflected in the School Construction Technical Assistance Manual, which is prepared by the Department of Education and which the Department of Education is required, under 14 Del. C. §103(c), to consult when calculating the voluntary school assessment;

WHEREAS, school construction cost formulas and collection of the voluntary school assessment currently varies among the counties and municipalities in this state;

WHEREAS, the Department of Education established a School Construction Planning Committee for the purpose of evaluating and recommending school construction cost formulas and other school construction cost data;

WHEREAS, the School Construction Planning Committee has, from time to time, issued reports consisting of, among other things, recommended revisions to school construction cost formulas and other school construction cost data;

NOW THEREFORE:

BE IT RESOLVED by the House of Representatives of the 146th General Assembly of the State of Delaware that the Delaware School Construction Working Group ("Working Group") is hereby created.

BE IT FURTHER RESOLVED that the Working Group shall be composed of the following members:

1.Two State Representatives, one from each party, appointed by the Speaker of the House;

2.The Secretary of Education or the Secretary's designee, who shall serve as chair of the Working Group;

3.The Director of the Office of Management and Budget or the Director's designee;

4.One Superintendent (or their designee) of any school district in New Castle County, to be appointed by the Secretary of Education;

5.One Superintendent (or their designee) of any school district in Kent County, to be appointed by the Secretary of Education;

6.One Superintendent (or their designee) of any school district in Sussex County, to be appointed by the Secretary of Education;

7.The President of the Home Builders Association of Delaware or the President's designee;

8.The Chairman of the Associated Builders and Contractors, Inc. Delaware Chapter or the Chairman's designee; 9.The President of the Delaware Contractors Association or the President's designee; and

10. A representative from the American Society of Heating, Refrigeration, and Air-Conditioning Engineers.

BE IT FURTHER RESOLVED that the Working Group, in consultation and coordination with the Department of Education, shall conduct an evaluation of the School Construction Planning Committee ("Committee") and school construction cost data.

BE IT FURTHER RESOLVED that such evaluation and subsequent report shall include an examination of how, if at all, the Committee's past findings and recommendations have impacted the voluntary school assessment, school construction formulas, and other school construction cost data; an examination and explanation regarding the methodology the Committee and the Department of Education uses in determining voluntary school assessment, school construction cost formulas, and other school construction cost data; an examination and explanation concerning how and why school construction cost formulas and collection of the voluntary school assessment currently varies among the counties and municipalities in this state; an examination and explanation as to how the Committee's members are chosen to serve and whether its members are representative of all counties, municipalities, people and industries that may be impacted by the voluntary school assessment, school construction formulas, and other school construction cost data; and any other findings or recommendations the Working Group and Department of Education may find relevant in their evaluation.

BE IT FURTHER RESOLVED that the Working Group and Department of Education shall provide a joint report reflecting the Working Group's and Department of Education's findings and recommendations to the Governor and General Assembly by January 15, 2013.

This House Resolution creates the Delaware School Construction Working Group to evaluate the School Construction Planning Committee and school construction cost data.
