145th GENERAL ASSEMBLY

HOUSE CONCURRENT RESOLUTION NO. 60

RECOGNIZING THE WEEK OF OCTOBER 3RD, 2010, AS "DELAWARE LONG-TERM CARE RESIDENTS' RIGHTS WEEK" AND PRAISING THE DELAWARE CHAPTER OF THE NATIONAL CONSUMER VOICE FOR QUALITY LONG-TERM CARE ON ITS 9TH RESIDENTS' RIGHTS RALLY.



WHEREAS, there are more than 2.5 million Americans residing in nursing homes and assisted living facilities throughout our country; and

WHEREAS, the federal Nursing Home Reform Act of 1987 ("NHRA") established national quality standards for nursing homes to assure that residents of long-term care facilities are guaranteed the individuals rights essential to human dignity; and

WHEREAS, the Resident's Bill of Rights established by NHRA guarantees long-term care residents: the right to freedom from abuse, mistreatment, and neglect; the right to freedom from physical restraints; the right to privacy; the right to accommodation of medical, physical, psychological, and social needs; the right to participate in resident and family groups; the right to be treated with dignity; the right to exercise self-determination; the right to communicate freely; the right to participate in the review of one's care plan, and to be fully informed in advance about any changes in care, treatment, or change of status in the facility; and the right to voice grievances without discrimination or reprisal; and

WHEREAS, the State of Delaware, through the Delaware Nursing Home Residents Quality Assurance Commission and the Department of Health and Social Services' Division of Long-Term Care Residents Protection, is dedicated to assuring that residents of long-term care facilities in this State receive the quality of care and individual rights guaranteed by NHRA; and

WHEREAS, the General Assembly believes that all residents of long-term care facilities should be aware of their rights so that they may be empowered to live with dignity and self-respect; and

WHEREAS, The National Consumer Voice for Quality Long-Term Care has annually dedicated the first full week of October as "Residents' Rights Week" to honor and recognize individuals living in long-term care facilities; and

WHEREAS, the Delaware Chapter of The National Consumer Voice for Quality Long-Term Care has worked to promote long-term care residents' rights by holding a Residents' Rights Rally, making Delaware the only state to hold a statewide rally for long-term care residents' rights; and

WHEREAS, the 9th Residents' Rights Rally will be held this year on October 5, 2010; and

WHEREAS, the General Assembly wishes to honor and celebrate the rich individuality of this State's long-term care residents, and to reaffirm their rights as community members and citizens, including the right to have a say in their care.

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 145th General Assembly of the State of Delaware, the Senate concurring therein, that the week of October 3, 2010, through October 9, 2010, is hereby designated as "Delaware Long-Term Care Residents' Rights Week."

BE IT FURTHER RESOLVED that the General Assembly hereby praises Delaware Chapter of The National Consumer Voice for Quality Long-Term Care for its efforts to promote residents' rights through it 9th Residents' Rights Rally, to be held this year on October 5, 2010.


SYNOPSIS

This concurrent resolution recognizes the week of October 3, 2010, as "Delaware Long-Term Care Residents' Rights Week" and praises the Delaware Chapter of the National Consumer Voice for Quality Long-Term Care for its efforts to promote residents' rights through its 9th Residents' Rights Rally, being held this year on October 5, 2010.
