CREATING THE DELAWARE HEALTH FUND WORKING GROUP. |
WHEREAS, funds received from the master settlement agreement ("tobacco settlement agreement") entered into by the State and tobacco manufacturers are deposited into the Delaware Health Fund; and
WHEREAS, the Delaware Health Fund Advisory Committee was created to make recommendations within certain guidelines for the expenditure of funds from the Delaware Health Fund; and
WHEREAS, it has been over 12 years since the Delaware Health Fund and the Delaware Health Fund Advisory Committee was created;
NOW, THEREFORE:
BE IT RESOLVED by the House of Representatives of the 146th General Assembly of the State of Delaware, the Senate concurring therein, that the Delaware Health Fund Working Group ("Working Group") is hereby created.
BE IT FURTHER RESOLVED that the Working Group shall be composed of the following members:
1. One State Representative, who serves on the Joint Finance Committee, appointed by the Speaker of the House;
2. One State Representative, who serves on the Delaware Health Fund Advisory Committee, appointed by the Speaker of the House and who shall serve as a Co-Chair of the Working Group;
3. One State Senator, who serves on the Joint Finance Committee, appointed by the President Pro Tempore;
4. One State Senator, who serves on the Delaware Health Fund Advisory Committee, appointed by the President Pro Tempore and who shall serve as a Co-Chair of the Working Group;
5. The Director of the Office of Management and Budget or the Director's designee;
6. One representative of the Office of Management and Budget appointed by the Director of the Office of Management and Budget;
7. One representative from the Department of Health and Social Services appointed by the Secretary of the Department of Health and Social Services; and
8. Two public members of the Delaware Health Fund Advisory Committee appointed by the chairperson of the Delaware Health Fund Advisory Committee.
BE IT FURTHER RESOLVED that the Working Group shall study and make recommendations on how the money received from the tobacco settlement can best be spent to meet the intent of the tobacco settlement agreement which is to provide services to treat and prevent illnesses associated with the use of tobacco products.
BE IT FURTHER RESOLVED that the Working Group shall make recommendations on how to best utilize the talent and expertise of the Delaware Health Fund Advisory Committee to identify and provide initial funding for innovative programs to meet the objectives of the tobacco settlement agreement.
BE IT FURTHER RESOLVED that the Working Group shall provide a report of its recommendations to the Governor and the General Assembly by January 1, 2013.
