HOUSE CONCURRENT RESOLUTION NO. 38

ENCOURAGING CONFORMANCE WITH THE PROHIBITION ON THE USE OF ELECTRONIC COMMUNICATION DEVICES WHILE OPERATING A MOTOR VEHICLE ON THE HIGHWAYS OF THE STATE OF DELAWARE.



WHEREAS, House Substitute No. 1 for House Bill No. 229 was signed into law on July 6, 2010; and

WHEREAS, this bill prohibits the use of electronic communication devices while operating a motor vehicle on the highways of the State of Delaware while such vehicle is in motion unless the person engages in the use of hands-free equipment; and

WHEREAS, electronic distracted driving is becoming the new DUI and is considered the most dangerous of the distracted driving activities; and

WHEREAS, the year 2012 began with 35 states having banned text messaging while driving; and

WHEREAS, the National Transportation Safety Board (NTSB) has called for high-visibility enforcement to support distracted driving bans as well as campaigns to inform motorists of the new law and heightened enforcement, have banned all hand-held cell phone use by commercial drivers, and are encouraging technological solutions to be adopted to prohibit texting and cell phone use while driving; and

WHEREAS, no call, no text, no update is worth a human life; and

WHEREAS, a recent National Highway Traffic Safety Administration report estimated that 13.5 million drivers are on cell phones during any moment in daylight hours; and

WHEREAS, there's no question that cellular device use in the vehicle is and will continue to be one of the biggest safety challenges facing society; and

WHEREAS, technology and direct cell phone carrier participation, along with education and awareness campaigns, can play the key role in mitigating the impact of this needless deadly and costly societal issue; and;

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 146th General Assembly of the State of Delaware, the Senate concurring therein, that we hereby encourage conformance with the law prohibiting the use of electronic communication devices while operating a motor vehicle on the highways of the State of Delaware and encourages public education and awareness campaigns to encourage the use of hands-free technology.

BE IT FURTHER RESOLVED that cell phone carriers, automobile manufacturers, and cell phone manufacturers are encouraged to make every reasonable effort to continue promoting awareness of this issue with their customers and to help implement technological solutions that will allow their customers to choose to prevent or limit the use of their cell phones while driving.

BE IT FURTHER RESOLVED that cell phone carriers, automobile manufacturers, and cell phone manufacturers are encouraged to make every reasonable effort to limit the ability of cell phones to send and receive text messages if the cell phone carrier is notified that a particular cell phone user is at that moment driving.

BE IT FURTHER RESOLVED that a suitably prepared copy of this resolution be presented to the Office of the Secretary of the Department of Safety and Homeland Security.


SYNOPSIS

This resolution encourages conformance with the law prohibiting the use of electronic communication devices while operating a motor vehicle on the highways of the State of Delaware, encourages cell phone carriers, automobile manufacturers, and cell phone manufacturers to continue public awareness campaigns, and further encourages cell phone carriers, automobile manufacturers, and cell phone manufacturers to adopt and implement, as quickly as possible, available technologies that will allow their customers to restrict the use of their cell phones while driving.
