ESTABLISHING THE TASK FORCE ON CHILD SUPPORT TO STUDY AND MAKE FINDINGS AND RECOMMENDATIONS REGARDING EFFECTIVE COLLECTION OF CHILD SUPPORT ARREARS. |
WHEREAS, as of September 30, 2012, child support arrears in the State of Delaware totaled $289,191,325; and
WHEREAS, the stated mission of the Delaware Division of Child Support Enforcement is "to promote family independence by reducing dependency of single parent households through collection of child support payments, and medical support, from non-custodial parents"; and
WHEREAS, the Delaware Division of Child Support Enforcement's mission is best achieved, in part, through efficient and effective collection and prompt distribution of child support payments; and
WHEREAS, it is the intent of the General Assembly that a task force of qualified persons study child support collection efforts in this state and develop strategies and a plan to reduce the total number of child support arrears.
NOW, THEREFORE:
BE IT RESOLVED by the House of Representatives of the 147th General Assembly of the State of Delaware, the Senate concurring therein, that the Task Force on Child Support Collection be established to study and make findings and recommendations regarding a statewide plan to reduce total number of child support arrears.
BE IT FURTHER RESOLVED that the Task Force be composed of the following members:
(1) two members of the House of Representatives, appointed by the Speaker of the House;
(2) two members of the Senate, appointed by the President pro tempore of the Senate;
(3) a representative of the Division of Child Support Enforcement, appointed by the Secretary of the Department of Health and Social Services;
(4) two members from the Delaware Family Court, appointed by the Chief Judge of the Family Court;
(5) a representative of the Department of Justice, appointed by the Attorney General; and
(6) one person from each county, appointed by the Governor;
BE IT FURTHER RESOLVED that the members of the Task Force choose a chairperson from among themselves at the initial organizational Task Force meeting.
BE IT FURTHER RESOLVED that the Speaker of the House of Representatives set the date, time, and place for the initial meeting;
BE IT FURTHER RESOLVED that when a chairperson of the Task Force has been designated, the chairperson be responsible for guiding the administration of the Task Force by, at a minimum:
(1) supervising the preparation and distribution of meeting notices, agendas, minutes, correspondence, and reports of the Task Force; and
(2) ensuring that the final report of the Task Force is submitted to the Speaker of the House of Representatives and the President pro tempore of the Senate, with a copy to the Governor and to the Director and the librarian of the Division of Research of Legislative Council and to the Delaware Public Archives.
BE IT FURTHER RESOLVED that the Department of Health and Social Services may provide reasonable and necessary support staff and materials for the Task Force.Task Force members shall serve without compensation.
BE IT FURTHER RESOLVED that the Task Force report its findings and recommendations to the Speaker of the House of Representatives, the President pro tempore of the Senate, the Governor, the Department of Health and Social Services; and the Directors of the Division of Research and the Delaware Public Archives for public dissemination by one year from the date of passage of this Resolution.
SYNOPSIS
This Resolution establishes the Task Force on Child Support Collection to study and make findings and recommendations regarding a statewide plan to reduce the total number of child support arrears.The Task Force shall present a final report of its findings and recommendations to the Governor and the General Assembly within one year of the passage of this Resolution.The Task Force is comprised of eleven (11) persons, appointed by the Speaker of the House, President pro tempore, the Attorney General, the Secretary of the Department of Health and Social Services, and the Governor as specified. |
