HOUSE CONCURRENT RESOLUTION NO. 153

DIRECTING THE DEPARTMENT OF EDUCATION AND THE DEPARTMENT OF HEALTH AND SOCIAL SERVICES TO PRODUCE A REPORT OUTLINING THE CREATION OF A STUDENT INJURY MONITORING SYSTEM.

WHEREAS, student health and well-being are paramount to academic success and overall development; and

WHEREAS, injuries that require surgery, pain management, physical therapy, and concussions can significantly impact a student's ability to participate in school activities; and

WHEREAS, effective injury management of students requires coordination between medical professionals and school nurses, counselors, athletic trainers, and any other necessary medical professionals working in schools; and

WHEREAS, a student injury monitoring system would facilitate the sharing of relevant injury information among these professionals to ensure comprehensive care and support for injured students during the school day; and

WHEREAS, such a system must comply with health information privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA) and the Family Educational Rights and Privacy Act (FERPA); and

WHEREAS, understanding the circumstances under which injuries occur is critical for developing preventive measures and ensuring student safety.

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 152nd General Assembly of the State of Delaware, the Senate concurring therein, that the Department of Education and the Department of Health and Social Services are hereby directed to jointly produce a comprehensive report outlining the creation of a student injury monitoring system.

BE IT FURTHER RESOLVED that this report shall include, but not be limited to, the following elements:

(a) An assessment of the current methods used for tracking student injuries and the gaps that exist in the current system.

(b) A detailed proposal for a student injury monitoring system that allows injury information from medical professionals to be accessible by school nurses, counselors, athletic trainers, and any other necessary medical professionals working in schools.

(c) Specifications on the types of injuries to be included in the system, specifically those requiring surgery, pain management, physical therapy, and concussions.

(d) Mechanisms to ensure compliance with health information privacy laws, including HIPAA and FERPA.

(e) Protocols for documenting how injuries occurred, to aid in prevention and safety measures.

(f) Technological and logistical requirements for the implementation of the system, including necessary software, training for personnel, and estimated costs.

(g) Recommendations for ensuring secure and efficient data sharing and management.

BE IT FURTHER RESOLVED that the Department of Education shall leverage its expertise in managing student information and collaborating with school districts, while the Department of Health and Social Services shall utilize its relationships with the health care providers and systems in the preparation of this report.

BE IT FURTHER RESOLVED that the completed report shall be submitted to the Governor, the Speaker of the House, and the President Pro Tempore of the Senate no later than August 31, 2025.
