AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE RELATING TO HIGHWAYS AND FINES FOR VIOLATIONS OF CLEAR ZONES WITHIN RIGHTS-OF-WAY. |
Section 1.Amend §525(c), Chapter 5, Title 17 of the Delaware Code by striking the subsection in its entirety and substituting in lieu thereof the following:
"(c)(1) For the first item removed the owner of any obstruction removed pursuant to this section shall be liable for a civil fine of $50.00, payable to the Department.
(2) For the second or subsequent items removed for violating this section the owner of the obstruction removed pursuant to this section shall be liable for a civil fine of $75 for each item so removed, payable to the Department.
(3) Justices of the Peace shall have original jurisdiction for any court proceedings relating to the above civil fines.
(4) No owner of any such obstruction shall be entitled to the return of any removed obstruction without proof of payment of all outstanding fines.".
SYNOPSIS

This bill increases the civil fine for violating the clear zone requirement along highway rights-of-way.The current civil fine is $25 per item.The new fine will be $50 for the first item in violation and $75 for each subsequent item. |
