AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO PREVAILING WAGE REQUIREMENTS. |
Section 1.Amend §6960, Title 29 of the Delaware Code by making insertions as shown by underlining as follows:
(m) For any contract or aggregate of contracts for a public works project that would otherwise be subject to this section, the contracting agency may, in its sole discretion, opt out of the requirement that prevailing wages be paid to all mechanics and laborers on that project.In the event the contracting agency opts out of the prevailing wage requirement it shall require the specifications for such contract or aggregate of contracts to state that the project is not subject to the requirements of this section.For purposes of this subsection, the term �contracting agency' means the Superintendent of any school district, or the Secretary, Director or Chief Officer of any state agency, or their designee, authorized to enter into any contract or aggregate of contracts for a public works project.
