145th GENERAL ASSEMBLY

HOUSE BILL NO. 460

AN ACT TO AMEND TITLE 9 AND TITLE 22 OF THE DELAWARE CODE RELATING TO ACCESSIBILITY FOR PERSONS WITH DISABILITIES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend Title 9 of the Delaware Code by adding a new §310A that reads as follows:

"§310A.Access for persons with disabilities.

(a) The county government of each of the 3 Delaware counties shall adopt regulations or ordinances that adopt the Standards for Accessible Design in Appendix A to 28 CFR Part 36 no later than February 15, 2011.

(b) The regulations or ordinances adopted pursuant to subsection (a) of this section must include an enforcement provision and a penalty provision.The county governments shall strictly enforce the requirements of the regulations or ordinances.".

Section 2. Amend Title 22 of the Delaware Code by adding a new §110A. that reads as follows:

"§110A.Access for persons with disabilities.

(a) All municipalities within the State shall adopt regulations or ordinances that adopt the Standards for Accessible Design in Appendix A to 28 CFR Part 36 no later than February 15, 2011.

(b) The regulations or ordinances adopted pursuant to subsection (a) of this section must include an enforcement provision and a penalty provision.Municipalities shall strictly enforce the requirements of the regulations or ordinances.".


SYNOPSIS

This bill requires counties and municipalities within the State to adopt the Standards for Accessible Design in Appendix A to 28 CFR Part 36 and to enforce the requirements set forth in the Standards for Accessible Design.
