AN ACT TO AMEND TITLE 9 AND TITLE 22 OF THE |
Section 1. Amend Title 9 of the Delaware Code by adding a new §310A that reads as follows:
"§310A.Access for persons with disabilities.
(a) The county government of each of the 3
(b) The regulations or ordinances adopted pursuant to subsection (a) of this section must include an enforcement provision and a penalty provision.The county governments shall strictly enforce the requirements of the regulations or ordinances.".
Section 2. Amend Title 22 of the Delaware Code by adding a new §110A. that reads as follows:
"§110A.Access for persons with disabilities.
(a) All municipalities within the State shall adopt regulations or ordinances that adopt the Standards for Accessible Design in Appendix A to 28 CFR Part 36 no later than February 15, 2011.
(b) The regulations or ordinances adopted pursuant to subsection (a) of this section must include an enforcement provision and a penalty provision.Municipalities shall strictly enforce the requirements of the regulations or ordinances.".

This bill requires counties and municipalities within the State to adopt the Standards for Accessible Design in Appendix A to 28 CFR Part 36 and to enforce the requirements set forth in the Standards for Accessible Design. |
