HOUSE BILL NO. 424

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO PUBLIC WORKS CONTRACTING.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §6962(d)(8)b., Title 29 of the Delaware Code by deleting the second sentence in its entirety and substituting in lieu thereof:

"The security of the unsuccessful bidders shall be returned to them immediately upon the awarding of the contract or the rejection of all bids, but in no event later than 30 days after the opening of bids with the exception of school districts, the Department of Education, and any political subdivision of the State, which shall be no more than 60 days unless the contracting agency, school district, or any political subdivision of the State extends the bid evaluation period by 5 working days per the requirements of paragraph (d)(13)a. of this section.".

Section 2.Amend §6962(d)(13)a., Title 29 of the Delaware Code by inserting "and any political subdivision of the State" after the words "Any public school district and its board" and before the words "shall award public works contracts".

Section 3. Amend §6962(d)(13)a., Title 29 of the Delaware Code by inserting the language "or political subdivision of the State" after the language "days and a school district" and before the language "shall extend".

Section 4.Amend §6962(d)(13)a., Title 29 of the Delaware Code by inserting the language "or political subdivision of the State" after the language "case of a school district" and before the period ".".

Section 5.Amend §6962(d)(13)a., Title 29 of the Delaware Code by deleting the language "or school district" as it appears after the language "contracting agency" and before the language "shall notify" and inserting in lieu thereof the language ", school district, or political subdivision of the State".

Section 6.Amend §6962(d)(13)a., Title 29 of the Delaware Code by inserting the language "or political subdivision of the State" after the language "case of a school district" and before the language ", that the bid".

Section 7.Amend §6962(d)(13)a., Title 29 of the Delaware Code by deleting the language "or school district" as it appears after the language "the agency" and before the language "shall award" and inserting in lieu thereof the language ", school district, or political subdivision of the State".

SYNOPSIS

This bill changes the bid awarding process for any political subdivision of the State of Delaware from 30 days to 60 days for large public works contracts.
