HOUSE BILL NO. 403

AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOUSING.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §7005, Title 25 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§7005 Requisites for rental of a manufactured home lot.

A landlord shall not rent a lot in a manufactured home community without first delivering to the prospective tenant a copy of the proposed rental agreement, a copy of the rules, standards and fee schedule of the manufactured home community, a copy of this subchapter, and a summary of this subchapter written by the Office of the Attorney General and made available to all landlords prior to January 1, 2012, all of which shall be delivered to the prospective tenant at the time the prospective tenant obtains from the landlord an application for tenancy in the community. The prospective tenant shall acknowledge such delivery by signing a receipt and shall provide to the landlord a copy of the manufactured home's title and written confirmation of the manufactured home owner's intent to rent.

Section 2.Amend §5105(a), Title 25of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(a) On each written rental agreement, the landlord shall prominently disclose:

(1) The names and usual business addresses of all persons who are owners of the rental unit or the property of which the rental unit is a part, or the names and business addresses of their appointed resident agents, and when the rental unit is a manufactured home located in a manufactured home community and subject to Chapter 70, Subchapter I of this title, such disclosure shall include copies of the manufactured home's valid title and authoritative written documentation of the owner's intent to rent; and/or

(2) The names and usual business addresses of any person who would be deemed a landlord of the unit pursuant to §5141 of this title, and when the rental unit is a manufactured home located in a manufactured home community and subject to Chapter 70, Subchapter I of this title, such disclosure shall include copies of the manufactured home's valid title and authoritative written documentation of the owner's intent to rent.

Section 3.This Act shall take effect upon its enactment into law, and shall apply to all leases renewed or entered into after this Act takes effect.


SYNOPSIS

Section 1 of this bill requires a prospective tenant seeking to rent a lot in a manufactured housing community to provide to the landlord a copy of the manufactured home's title and written confirmation of the manufactured home owner's intent to rent.

Section 2 of the bill requires that copies of the manufactured home's title and documentation of the owner's intent to rent to be disclosed with a rental agreement for a manufactured home.
