HOUSE BILL NO. 39

AN ACT TO AMEND CHAPTER 27 OF TITLE 21 OF THE DELAWARE CODE RELATED TO SCHOOL BUS ENDORSEMENT HOLDER CRIMINAL BACKGROUND CHECKS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend Section 2708(f), Title 21 of the Delaware Code by substituting the word "shall" for the word "may" appearing therein and by adding the following sentence at the end of the subsection:

"This check shall include a national criminal history background check, in addition to a review of the applicant's Delaware-based criminal history, a fingerprinting of applicants who are to be subjected to a national criminal history background check, and expressly authorizes the use of records of the Federal Bureau of Identification for screening the applicants.".


SYNOPSIS

This housekeeping bill is intended to update the state law regarding criminal background checks for those seeking a school bus driver endorsement from DMV to comply with federal requirements for access to the national criminal history records kept by the FBI.
